1. Who we are and how to reach us

We are Dairy Designs Ltd, trading as The Dairy. We are registered in England and Wales under company number 13162560, with our registered office at 20-22 Wenlock Road, London N1 7GU, United Kingdom. Our VAT number is GB371001449.

For anything to do with an order, please email support@thedairy.com. For everything else, hello@thedairy.com.

In these Terms, "we", "us" and "our" mean Dairy Designs Ltd. "You" means you, whether you are shopping for yourself or on behalf of a business.

"Site" means thedairy.com and any related mobile site, application, media channel or page we operate. "Services" means the Site together with the products, features and services we make available through it.

2. About these Terms

These Terms of Service are a legally binding agreement between you and us covering your access to and use of the Services. By using the Services you confirm you have read, understood and accepted them.

If you are a consumer, nothing in these Terms removes or limits your statutory rights under the law of the country you live in. Where these Terms conflict with those rights, your statutory rights apply.

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top. Please check this page from time to time so you know which version applies. Continuing to use the Services after an update means you accept the revised Terms. Where a change materially affects an order you have already placed, the version of these Terms in force when you placed that order will continue to apply to it.

Any additional terms we publish on the Site, including promotional terms, shipping information, our returns policy and our warranty page, form part of these Terms.

3. Where we sell and local laws

We sell internationally from the United Kingdom. Nothing on the Site is intended for anyone in a country where offering it would be unlawful. If you access the Site from outside the countries we ship to, you do so on your own initiative and you are responsible for complying with your local law.

4. Who can use the Services

You need to be at least 18 to place an order. If you are under 18 you may browse the Site, but any order must be placed by a parent or guardian who accepts these Terms on your behalf and takes responsibility for it.

By using the Services you confirm that the information you give us is true, accurate and current, that you have the legal capacity to agree to these Terms, and that you will not use the Services for any unlawful purpose.

If information you give us turns out to be untrue, inaccurate or incomplete, we may suspend or close your account.

5. Your account

You do not need an account to shop with us, but you may create one. Keep your password confidential. You are responsible for activity that happens under your account.

We may remove or change a username if we reasonably consider it inappropriate, offensive or misleading.

6. Our products and how we make them

Our printed products are made to order. Nothing is printed until you place your order. Some accessories and other products may be held in stock. This is deliberate. Producing our printed products this way helps us reduce waste and means we can carry a large catalogue of artist designs rather than only the ones that sell fastest.

Production usually takes 2 to 5 business days before your order is dispatched. Shipping time is additional and depends on where you are and shipping method selected. While we offer a time for delivery this can vary due to factors outside of our control like weather, strikes or post office errors. We make every effort to show colours, finishes, features and details as accurately as we can. Screens vary, and printed artwork on a physical case will not always look identical to an image on a backlit display. Variations in colour and finish are normal and are not a fault.

All products are subject to availability. We may discontinue a product or a design at any time. Some artist designs are available for a limited period only.

7. Orders, pricing and payment

Placing an order. Your order is an offer to buy. When you check out we will email you an acknowledgement confirming we have received your order. That acknowledgement is not our acceptance of it.

A contract between us is formed when we email you to confirm that we have accepted your order and it is going into production. If we cannot accept your order, we will tell you and refund any payment taken in full.

Choosing the right model. Because your product is made to order, please check carefully that you have selected the correct phone, tablet or laptop model before you complete checkout. If you spot a mistake, contact support@thedairy.com straight away. We will do everything we reasonably can to correct it before production starts, but once production has begun we may not be able to change it.

Prices and currency. Prices are shown in the currency you select at checkout and payment is taken in that currency. The currency shown, and the price in it, may differ between regions. Your bank or card issuer may apply its own conversion or foreign transaction charges, which are outside our control.

Prices may change at any time, but a change will never affect an order we have already accepted. Taxes and duties are applied where required. Where duties or import charges apply to your delivery country, these are shown or explained at checkout wherever we are able to do so. Where they are not collected by us, any duties or import charges are your responsibility.

Payment methods. The payment methods available to you are shown at checkout and vary by country. They currently include Visa, Mastercard, American Express, UnionPay, Shop Pay, Apple Pay, Google Pay, PayPal, Afterpay, which trades as Clearpay in the United Kingdom, and Sezzle. Buy now pay later options are only offered in some markets. We may add or remove payment methods at any time.

Errors. We take care with pricing, but if a product is listed at an obviously incorrect price we may cancel the order and refund you in full rather than supply at that price.

Refusing or limiting orders. We may refuse an order, or limit quantities per person, household or order. This includes orders that appear to be placed for resale or distribution. We do not sell wholesale through the Site. For bulk, corporate or branded orders, please contact us at pr@thedairy.com.

8. Shipping and delivery

We offer free standard shipping to every country we ship to. Tracked and express options are available depending on your location. Free shipping does not include tracking in every region.

Risk in the goods passes to you on delivery.

Navidium shipping protection is an optional add on at checkout. Where you have purchased it and your order is lost, stolen or damaged in transit, we will send a replacement. Navidium covers replacements, not refunds. This is in addition to, and does not affect, your legal rights against us for goods that do not arrive.

9. Returns, changing your mind and cancellations

Our returns promise. We offer 30 days from delivery to return or exchange a product you have changed your mind about, provided it is in resaleable condition. By that we mean removed from your device, undamaged, unmarked, and returned with any packaging it arrived in. Trying a case on your phone to check the fit will not void your return. Signs of use such as scratches, marks, adhesive residue or wear will. Return postage is your responsibility. Express postage and Navidium shipping protection fees already paid are not refundable once your order has shipped.

Custom and Create products are final sale. Anything made through our Custom or Create service is produced from your own artwork or personalisation and cannot be resold. These items cannot be returned or exchanged unless they are faulty or we have made an error.

If you are in the European Union. You have a statutory right to withdraw from your purchase within 14 days. That right does not apply to goods made to your specification or clearly personalised, which includes anything made through our Custom or Create service. You can exercise your right of withdrawal through the option in your order confirmation or by contacting our Customer Care team. Our 30 day returns promise sits alongside this right and does not replace it.

If you are in the United Kingdom. Your statutory rights under the Consumer Contracts Regulations and the Consumer Rights Act 2015 apply in full, subject to the same exception for personalised goods.

Faults and errors. If a product arrives faulty, damaged or is not what you ordered, none of the above applies. Email support@thedairy.com with your order number and a photo and we will sort it out, at our cost.

Starting a return. Email support@thedairy.com with your order number and we will send you the correct return address and instructions.

We handle returns regionally, matched to where your order was produced. That means you will be returning within your own region and will not be asked to post internationally. Please do not send anything back before you have heard from us, as sending to the wrong address will delay your refund.

Cancelling before dispatch. Because we produce on demand, we may already have started making your order. Contact us as soon as possible and we will cancel where we still can.

10. Warranty

Standard warranty: 6 months. We warrant our products against manufacturing defects and faults for 6-months from the date your order is delivered. If a covered fault appears, we will replace the product with an equivalent one at no cost, and we will cover standard shipping on the replacement. Express shipping on a replacement is available at additional cost.

VIP warranty: 12 months. Once you have placed three or more orders with us you become a VIP customer, and you stay one. Orders that have been fully refunded do not count towards the three. Your third order and every order after it carries a 12 month warranty from delivery instead of 6. You do not need to do anything to claim it. We can see your order history and apply it automatically.

What is covered. Manufacturing defects and faults in our own branded products. This includes faults in materials, printing or assembly that were present at the time your product was delivered.

Our remedy

Because our products are made to order, the original design may no longer be available. Where we cannot supply the same design, we will offer you a comparable alternative, a store credit or a refund of the price paid, at our discretion.

A replacement product carries the remainder of the original warranty period. It does not start a new warranty period. This includes replacements or orders created from CS codes for custom designs.

Exclusions from this warranty. This warranty does not cover:

(a) damage caused by accident, impact, crushing, liquid exposure, heat, or exposure to solvents, adhesives, perfumes, sunscreens or other cosmetic products;

(b) cosmetic changes arising from normal use or the passage of time, including scratches, scuffs, dents, marks, print rub or wear at edges and corners, and yellowing or clouding of clear and translucent materials;

(c) gradual deterioration of materials through use or age, including softening or stretching of flexible components;

(d) misuse, abuse, neglect, use other than for the product's intended purpose, or failure to follow any care instructions we provide;

(e) modification, alteration, repair or attempted repair by anyone other than us or a party we authorise;

(f) products not purchased directly from thedairy.com, including products purchased from unauthorised resellers and other authorized third parties;

(g) products that are lost, stolen or otherwise no longer in your possession; and

(h) any loss of or damage to a device or its contents.

No device warranty. Some of our products are constructed to offer a degree of drop and impact resistance. Where we describe a product in those terms, we are describing its construction and materials. It is not a guarantee that your device will not be damaged.

Whether a device is damaged in any given incident depends on many factors outside our control, including the height, angle and force of the impact, the surface struck, the model, age and condition of the device, whether the product was correctly and fully fitted, and whether a screen protector or other accessory was in use. For this reason we do not warrant that any product will prevent damage to a device.

We are not responsible for the repair or replacement cost of any phone, tablet, watch, laptop or other electronic device, or for any data loss, however caused.

Bulk and corporate orders. Where you have bought from us as a business for bulk, corporate or branded supply, the standard and VIP warranties above do not apply. Instead you have 30 days from delivery to inspect the batch and tell us in writing about any manufacturing defects. We will replace defective units at no cost, including standard shipping. After that 30 day window we have no further warranty obligation in respect of that order. This does not affect any rights an end recipient may have under product liability law.

How to claim. Email support@thedairy.com with a photo. Our Customer Care will reply within one business day, Monday to Friday, excluding public holidays. We assess warranty claims and may verify a claim before approving it.  

Your statutory rights. This warranty is offered in addition to your legal rights as a consumer. It does not replace them or reduce them. In the United Kingdom and the European Union in particular, you may have rights that extend beyond the periods above.

11. Looking after your product

Our cases use premium grade materials. With daily use they will pick up marks and show signs of wear, which is normal and is not a fault.

Clean gently with a soft damp cloth and mild detergent or soapy water, with your device removed from the case first. Avoid abrasive, alcohol based or acidic cleaners.

Harsh chemicals can transfer onto the case from your hands or your bag and affect the printed inks, causing colour change, fading or softening of the print. The most common culprits are hand sanitiser, alcohol wipes, nail polish remover, perfume and aftershave, sunscreen, insect repellent, hair products and cleaning sprays. None of these need to be applied to the case to have an effect, contact from your hands or from a spill inside a bag is enough. If your case does come into contact with any of them, rinse it with water and dry it with a soft cloth as soon as you can.

12. Custom and Create

Our Custom and Create service lets you upload your own artwork, photographs or text and have it printed on a product.

Your rights in what you upload. Before you can place a Custom or Create order you are asked to confirm that you own the artwork you are uploading, or that you have all the rights, licences and permissions needed to have it reproduced by us, and that you have the consent of any identifiable person appearing in it. That confirmation forms part of these Terms and we rely on it.

We do not review every upload. We operate risk based checks and we may refuse, hold or cancel any order at our discretion, but the responsibility for having the right to use the artwork sits with you.

Your licence to us. You keep ownership of what you upload. You grant us a limited, non exclusive, royalty free licence to store, reproduce, print, adapt for production purposes and ship your artwork, solely for the purpose of fulfilling your order and dealing with any related warranty or support matter. We will not use artwork uploaded through Custom or Create in our marketing without asking you first.

Content we will not print. By using Custom or Create you agree not to upload material that is offensive or in bad taste. This includes but is not limited to:

  • content that infringes the rights of a third party
  • marks or symbols signifying hate towards a group of people
  • hate speech or racist terms
  • inappropriate content or nudity that is not artistic in nature
  • content exploiting the image or likeness of a minor
  • obscene or vulgar remarks, or content that harasses, threatens, defames or abuses another person
  • content depicting violence, or that is obscene, abusive, fraudulent or threatening
  • content glamorising the use of illegal substances or drugs
  • modifications to artwork created by the artists we work with. 

This list is a guide, not an exhaustive one. We may refuse or cancel any Custom or Create order at our discretion and will refund you where we do.

Your responsibility. If you are a business user, you agree to indemnify us against any claim, loss or cost we suffer because artwork you uploaded infringed someone else's rights or breached this section. If you are a consumer, you are responsible to us for the loss we suffer as a result of your breach of this section, to the extent the law allows.

Final sale. Custom created products are made specifically for you and are final sale, except where the product is faulty or has been manufactured incorrectly, meaning what you receive does not match what you ordered, such as the wrong case type or model.

13. Intellectual property

Our content. The Site, including its design, layout, software, source code, databases, text, photography, video and graphics, together with our trade marks and logos, is owned by us or licensed to us. It is protected by copyright, trade mark and other intellectual property laws.

Artist artwork. Many of the designs we sell are created by independent artists and are licensed to us under agreements with those artists. The artists retain ownership of their work. Buying a product gives you the product. It does not give you any right to reproduce, distribute, resell or commercially exploit the artwork on it. If you are an artist and believe your work is being used on the Site without permission, please contact hello@thedairy.com.

What you may do. You may access the Site and download or print portions of it for your own personal, non commercial use. Everything else is reserved.

What you may not do. You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, licence or otherwise commercially exploit any part of the Site or its content without our prior written permission.

14. Reviews and other contributions

We may invite you to leave reviews or post content on the Site.

When you post a review, please make sure you have first hand experience of what you are reviewing, that it does not contain profanity, abusive, racist or discriminatory language, that it does not reference illegal activity, that it is not false or misleading, and that you are not affiliated with a competitor posting a negative review. Please do not organise campaigns encouraging others to post reviews either way.

We may accept, reject or remove reviews at our discretion. We are not obliged to screen them. Reviews reflect the views of the people who wrote them, not ours.

Licence. By posting a review or other content on the Site, you grant us a non exclusive, worldwide, royalty free, transferable licence to host, store, reproduce, publish, display, adapt and distribute that content in connection with the Services and our marketing. You keep ownership of your content. You confirm you have the right to grant this licence and that your content does not infringe anyone else's rights.

Tagged social content. Where you tag us, mention us or use our hashtags on social media, you give us permission to reshare that content on our own social channels and on the Site, with credit to you. If we want to use your content in paid advertising, we will ask you first. You can ask us to remove your content at any time by emailing hello@thedairy.com and we will do so.

This does not apply to Custom and Create artwork. Where a product carries artwork you uploaded yourself, we will always ask your permission before using an image of it, whether or not you have tagged us. Section 12 takes priority over this section.

15. Acceptable use

You agree not to:

  • use the Services for any unlawful purpose, or in breach of any applicable law
  • systematically retrieve content from the Site to build a competing collection, compilation or database without our written permission
  • attempt to mislead or defraud us or other users, or obtain another user's account details
  • circumvent, disable or interfere with the security features of the Site
  • harass, abuse or harm another person using information obtained from the Site
  • misuse our support channels or submit false reports
  • impersonate another person or use another user's account
  • upload or transmit viruses, malware or any code that disrupts the Site
  • upload passive collection mechanisms such as web bugs or tracking pixels
  • interfere with or place an undue burden on the Site or the networks behind it
  • harass, intimidate or threaten our team
  • copy, adapt, decompile, disassemble or reverse engineer the Site's software, except to the extent the law permits
  • remove any copyright or proprietary notice from our content
  • use the Services to compete with us, or to promote products that substitute for ours

16. Automated access and shopping agents

We welcome legitimate automated access to the Site. This includes standard search engine crawling, and it includes AI shopping assistants and agents acting on behalf of a genuine customer to browse, compare or place an order.

If you are using an agent or assistant, you are responsible for its actions as though they were your own, and these Terms apply to the resulting order in full.

We do still prohibit automated activity that is abusive rather than genuine. That means bulk scraping of our catalogue to build a competing database, bots used to acquire stock for resale, credential stuffing, and any automation that degrades the Site for other people. We may apply reasonable rate limits and technical measures, and we may block automated traffic that breaches this section.

17. Third party sites and content

The Site may link to other websites or display content originating from third parties. We do not control or check these, and a link is not an endorsement. If you leave the Site, these Terms stop applying and the other site's terms take over. Any purchase you make on a third party site is between you and them.

18. Managing the Site

We may, but are not obliged to, monitor the Site for breaches of these Terms, take action against anyone who breaches them or the law, remove or restrict access to content, and otherwise manage the Site to protect it and keep it working properly.

19. Privacy

We care about your data. Please read our Privacy Policy, which forms part of these Terms.

The Site is operated from the United Kingdom. Where we transfer personal data internationally, we do so in line with applicable data protection law and as described in our Privacy Policy.

20. Copyright complaints

If you believe material on the Site, or artwork printed on a product we have supplied, infringes a copyright, trade mark or other right you own or control, please contact hello@thedairy.com. Please include details of the work, where it appears, and confirmation that you are the rights holder or are authorised to act for them.

We take this seriously and we will respond within 5 business days. Where a complaint is well founded we will remove the material, cancel and refund any affected order, and stop any further production of it.

21. Suspension and termination

These Terms apply for as long as you use the Services.

We may suspend or withdraw your access to the Site, or close your account, where you have materially breached these Terms, where we reasonably suspect fraudulent or unlawful activity, or where we are required to by law. Where it is reasonable and lawful to do so, we will tell you first.

If we close your account, this does not affect any order we have already accepted, your statutory rights, or any warranty already in place on a product you have bought.

22. Availability and changes to the Site

We cannot promise the Site will always be available. We may need to carry out maintenance, and technical problems can cause interruptions. We may change, update, suspend or discontinue any part of the Site.

Where we can reasonably do so, we will give notice before a planned interruption. We are not liable for a temporary interruption, but this does not affect our obligations in relation to an order we have already accepted.

23. Errors on the Site

The Site may occasionally contain typographical errors, inaccuracies or omissions, including in descriptions, pricing and availability. We may correct these and update information at any time without notice, subject to section 7 on pricing errors.

24. Our responsibility to you

What we never exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, or for anything else that cannot lawfully be limited. If you are a consumer, nothing in these Terms affects your statutory rights to goods that are of satisfactory quality, fit for purpose, as described, and matching any sample or model shown to you.

If you are a consumer. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if at the time you placed your order both of us knew it might happen.

We are not responsible for loss or damage that is not foreseeable, for loss caused by you selecting the wrong device model at checkout, for loss caused by an event outside our reasonable control as described in section 26, or for loss arising from use of a product otherwise than as intended.

We are not liable for business losses. If you use a product for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

If you are a business user. These provisions apply instead of the consumer provisions above.

We supply products for your internal use only. To the fullest extent permitted by law, all terms implied by statute or common law are excluded from our contract with you.

We are not liable to you, whether in contract, tort including negligence, breach of statutory duty or otherwise, for loss of profit, loss of revenue, loss of sales or business, loss of anticipated savings, loss of or damage to data, loss of goodwill, business interruption, or any indirect or consequential loss, in each case however arising.

Our total liability to you in connection with an order, whether arising from one claim or a series of connected claims, is limited to the total amount you paid for that order.

You must notify us of any shortage, visible damage or non conformity within 14 days of delivery, and of any other claim within 6-months of delivery, failing which we have no liability in respect of it, except claims under the warranty in section 10. 

No protection guarantee. Our products are design led accessories. Except where we have made a specific written protection claim about a particular product, we do not represent, warrant or guarantee that any product will prevent, reduce or limit damage to your device from dropping, impact, pressure, scratching, water, heat or any other cause. You should not rely on any product as a substitute for careful handling or device insurance.

Devices. We are not responsible for damage to your phone, tablet, watch, laptop or any other device, for the cost of repairing or replacing one, or for any data held on one. No device is covered by our warranty. This does not affect any liability we may have under product liability law where a defect in one of our products has caused damage.

Correct model selection. Because every product is made to order, you are responsible for selecting the correct device model at checkout. We will help where we can if you tell us quickly, but we are not liable for the cost of a product produced to an incorrect model selection.

25. Indemnity

If you are a business user, you agree to indemnify us, our officers, employees and partners against any loss, damage, liability, claim or demand, including reasonable legal costs, arising from your use of the Services, your breach of these Terms, your breach of any third party's rights, or content you have uploaded or posted.

This section does not apply to consumers.

26. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including supply chain disruption, industrial action, extreme weather, natural disaster, war, act of terrorism, epidemic, failure of public networks, or the acts of carriers and third party suppliers. Where such an event affects your order we will contact you as soon as we can, and if the delay is substantial you may cancel and receive a refund for anything not delivered.

27. Governing law and disputes

These Terms and any dispute arising from them are governed by the law of England and Wales.

If you are a consumer, you also keep the benefit of any mandatory consumer protection law of the country you live in, and you may bring proceedings in the courts of that country. If you live in the European Union, this means the mandatory provisions of your local law continue to apply to you.

We both agree to the non exclusive jurisdiction of the courts of England and Wales.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Complaints. If something has gone wrong, please tell us first at hello@thedairy.com. We would much rather fix it directly. If we cannot resolve it between us, you may be entitled to use an alternative dispute resolution scheme available in your country.

28. California residents

If a complaint with us is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone on (800) 952-5210 or (916) 445-1254.

29. Electronic communications

Visiting the Site, emailing us and completing forms are electronic communications. You consent to receiving communications from us electronically, and you agree that agreements, notices and disclosures we provide electronically satisfy any legal requirement that they be in writing.

30. General

These Terms, together with the policies referred to in them, are the entire agreement between us in relation to your use of the Services.

If we do not enforce a right straight away, that does not mean we have given it up.

If any part of these Terms is found to be unlawful or unenforceable, the rest continues to apply.

We may transfer our rights and obligations under these Terms to another organisation. We will tell you if this happens, and it will not affect your rights.

Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between us.
